GENERAL TERMS AND CONDITIONS OF SALE OF THE STARSHOP-MOTO SITE

Article 1 – Scope of application.
The detailed general terms and conditions of sale below (hereinafter referred to as the "General Terms and Conditions") govern the contractual relations between any user of the site WWW.STARSHOP-MOTO.COM, EURL with a capital of €6,000 Euros, registered in the trade and companies register of La Roche sur Yon. These general terms and conditions of sale are the only ones applicable and replace all other conditions, except for prior, express and written derogation. By accessing the site, you undertake to comply with the general conditions as well as the terms of use appearing therein.

Article 2 – Placing your order and validating it.

To place an order, we offer you three methods:

- By mail, accompanied by the printed and completed order form as well as your payment by check and a copy of your identity documents. We will inform you by email of its receipt. Products can only be delivered after the expiration of the check solvency verification period (between 10 and 15 days).

Each order requires your acceptance of the General Terms and Conditions of Sale. By checking the box provided for this purpose, you will fully accept these conditions without reservation. Without acceptance, no order can be validated. An email will be sent to you upon confirmation of the order at the email address you have provided us. Automatic registration systems are considered as proof of the nature, content and date of the order.

However, Starshop-moto reserves the right to refuse or cancel any order from a customer, particularly in the event of the customer's insolvency, in the event of non-payment or in the event of a dispute relating to the payment of a previous order.

The information provided by the customer when entering information about their order is binding. Starshop-moto cannot be held responsible for errors made by the customer in the wording of the recipient's details (delivery address, billing address, email and telephone number) and thus for delivery delays or the inability to deliver the ordered products that such errors may have caused.

Article 3 – Availability of products and delivery times.

Starshop-moto undertakes to honor your order within the limits of available stocks. Delivery times are generally between 24 hours and 15 days, except for specific products (bubbles, wheels, certain exhausts, specific fairings). The average delivery time is identified on the site for each product, if this is not the case, please consult us beforehand. Delivery times are given as an indication only; Starshop cannot be held responsible for any delay in delivery (due in particular to temporary or permanent stock shortages from our suppliers). A delay in delivery cannot constitute an automatic cause for the cancellation of this order. However, we undertake to reduce these times to a minimum and to offer you an alternative to the originally ordered product of equal value. Delivery is made between 24 and 72 hours after the date of dispatch depending on the chosen delivery method. In order to avoid problems during this delivery, we need to have all the necessary information: address, name, email address, telephone number, so that we can contact you in case of difficulties on the part of the courier. A shipment confirmation and a tracking number will automatically be sent to you.

Items and products benefiting from a special order will be delivered upon availability and / or on request. Any delay does not give the buyer the right to cancel the sale, to refuse the goods, to request damages or to claim any compensation whatsoever, as long as the information is available. Specific order cancellation is possible within the timeframe noted at the time of order.

In case of disputes, the customer must file a complaint with the postal service within the period indicated in the delivery service. A copy of the complaint must be sent to Starshop-moto, no claim will be accepted without this. STARSHOP reserves the right to check the item and take the necessary steps. The customer has 48 hours from the date of receipt to report the receipt of a damaged or incorrect product. No dispute will be accepted after this period. Product changes are subject to the decision of Starshop-moto and are not systematic. Any dispute will be settled by the competent French courts.

Article 4 – Delivery.

The customer has 48 hours from receipt to report to the carrier by registered letter with acknowledgment of receipt any loss or damage. A copy must be sent to Starshop-moto. The delivery times mentioned are indicative and any overrun cannot lead to damages, deductions or cancellation of orders in progress. If the products were delivered by a carrier, Starshop-moto declines all responsibility for delays caused by him. The risks of transportation are borne by the purchaser as from the date the products leave the company's premises. In the event of damage during transportation, the reasoned protest must be made within three days of delivery. The client must ensure that they have received the merchandise in good condition and that the carrier's references mentioned on the delivery note are in conformity with the goods delivered (quantity and quality) in accordance with their order. No claim will be accepted after this period.

In the event that the goods are returned by the carrier, the reasons for the return and a proof will be requested from the seller. Any re-shipment at the expense of the customer will be invoiced in advance.

Article 5 – Price.

Prices are inclusive of all taxes, net prices, from our warehouse. Prices are subject to change without notice. Orders are billed at the price in effect at the time of the order.

The items remain the property of Starshop-moto until the effective payment of the price by the customer. Starshop-moto reserves the right to request a photocopy of your identity card for any payment by check.

Article 6 – Payment and Security.

The payment of your purchases is made by credit card via the secure system developed by Société Générale. The card is debited on the day of your order, or if the order is in preparation, for any transaction over 100 euros, Starshop reserves the right to request a photocopy of your identity card as well as proof of address. The order will only be sent after acceptance of the payment. Payments made via Paypal are also accepted.

Article 7 – Right of withdrawal.

In accordance with the provisions of the Consumer Code, the consumer has a period of 14 working days to exercise their right of withdrawal without having to justify reasons or pay penalties, with the exception, where applicable, of return costs. This period runs from the receipt for goods or acceptance of the offer for services. When the period of 14 days expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day. In the event that the right of withdrawal is exercised, the consumer must return the product to Starshop-moto at the latest within 14 days following the notification of his decision to withdraw. Starshop-moto will reimburse the consumer for all amounts paid, including delivery charges, without undue delay and at the latest within 14 days from the day on which Starshop-moto is informed of the consumer's decision to withdraw from this contract. Starshop-moto may defer the refund until it has received the product or until the consumer has provided proof of shipment of the product, whichever comes first.

For more information, the consumer can contact the customer service of Starshop-moto or consult the terms and conditions of withdrawal on the site of the consumer. In the event of an exercise of the right of withdrawal, the return costs are the responsibility of the consumer.

The returned product must be in its original condition and packaging and must not have been used. In case of deterioration of the product resulting from manipulations other than those necessary to establish its nature, its characteristics and its good functioning, the responsibility of the consumer may be engaged. In case of exercising the right of withdrawal, the consumer is not required to bear the costs of returning the goods in the event that the professional has not informed the consumer that these costs are borne by the consumer.

Article 8 – Guarantees.

All our products are subject to the legal guarantee provided for by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned, exchanged or refunded.

Article 9 – Responsibility.

The products offered comply with current French legislation. Starshop-moto cannot be held liable for non-compliance with the legislation of the country where the products are delivered. Article 14 – Applicable Law and Dispute Resolution.

These general conditions of sale as well as the contractual relations between STARSHOP and the customer are subject to French law. In the event of a dispute, jurisdiction is attributed to the competent French courts, despite multiple defendants or warranty claims.
